Notice of Default <br />In cases where the private lender is servicing the loan, the lender <br />must agree to furnish the Oakdale EDA with written notice of any <br />default by the small business concern within thirty (30) days of the <br />date of default. The lender must give the Oakdale EDA sixty (60) <br />days notice prior to a foreclosure sale. This agreement must <br />incorporate provisions providing for a timely written notification <br />from the lender to the Oakdale EDA of any default, delinquency by <br />the small business concern on the lender's portion of the financing <br />and the right of the Oakdale EDA to an immediate purchase of the <br />lender's senior position in the loan thereby allowing the EDA the <br />opportunity to protect its position and to avoid the accumulation of <br />legal costs, preservation expenses, etc. <br />Loan Processing Repayment ability <br />Process for Analyzing <br />Loan Applications <br />An Oakdale Seed Fund Loan must be secured so as to reasonably <br />assure repayment. Reasonable assurance of repayment takes into <br />consideration earnings, management ability and financial condition <br />of the borrower as well as the value of collateral. <br />The intake of loan applications will be completed by the <br />Community Development Department staff of the City of Oakdale. <br />Upon receipt of a complete application, the staff will complete an <br />initial review to determine the ability of the program to address the <br />identified financing need. If the project meets the intent and <br />general parameters of the program, the application will be <br />forwarded to the city's economic development consultant who will <br />complete additional due diligence work on the application. The <br />consultant will provide a report on the loan request to the Loan <br />Committee of the EDA. The loan committee will make a <br />recommendation to the Economic Development Authority who <br />will make the final decision on the loan request. <br />Credit Information and Credit Reports <br />Upon receipt of the loan application, a credit report will be ordered <br />from the private lender participating in the project. The report will <br />be provided to the Oakdale EDA if the lender receives permission <br />from the borrower. If the application package includes an <br />acceptable credit report or sufficient credit information is supplied <br />by the small business concern/lender or is available from other <br />sources a new credit report may not be needed. Letters should be <br />written by the private lender to credit references and others where <br />60 <br />
