<br />Councilmember Kuzma introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #19-275 <br /> <br />RESOLUTION APPROVING RELEASE OF RIGHT OF RE-ENTRY AGREEMENT FOR <br />AFFINITY AT RAMSEY, LLC <br /> <br /> WHEREAS, <br />the City of Ramsey (the “City”), entered into a Right of Re-Entry Agreement <br />with Affinity at Ramsey, LLC (the “Buyer”) filed in the Anoka County Office of the Registrar of <br />Titles as document number 558797.009 (the “Agreement”); and <br /> <br />WHEREAS, <br />the Agreement required the Buyer to complete the market rate senior project <br />according to the approved site plan specifications within 30 months of the Closing date; and <br /> <br />WHEREAS, <br />the Buyer has provided the City of Ramsey with a Certificate of Occupancy <br />dated November 12, 2019 documenting the completion of the project prior to the 30 month <br />deadline; and <br /> <br />WHEREAS, <br />the Buyer has requested that the City release it from the Agreement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the City hereby authorizes the City Administrator and Mayor to sign the Release of <br />Right of Re-Entry Agreement releasing Affinity at Ramsey from document 558797.009; <br />subject to City Attorney approval. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Heinrich, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor LeTourneau <br /> Councilmember Kuzma <br /> Councilmember Heinrich <br /> Councilmember Menth <br /> Councilmember Musgrove <br /> Councilmember Riley <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br /> <br />
