Mayor Gamec stated the issue of forced hookup of services has been a concern for a lot of
residents. But, there are also residents who want to connect but can't get it. He advised that at
thc last workshop a discussion occurred that the ordinance language would be changed so a
residcn! would not have to connect unless they want it.

City Administrator Norman stated the draft language would repeal those parts of Section 4 and
repeal fi)rccd hookup.

Mayor Gamcc explained the intent is to take out of the Charter and Ordinance all clauses that say
if' sewer is available and your system fails, you have to connect. Also, the "due on sale"
connection will be repealed. He stated the City cannot absorb the cost to run the pipe up unless it
is paid tbr by those who need it.

Mr. I)an Murphy stated his sister lives in Ramsey and thinks this proposed change may ease
many rcsident's minds if they know that will be repealed.

Councihncmber F, lvig stated this has been a pet peeve of his for a long time because residents
don't like having to be forced to connect.

Motion by Councilmember Elvig, seconded by Councilmember Cook, to introduce an ordnance
amending Chapter 4 of the Ramsey City Code, which chapter is known as "Public Facilities and
hn provcmcnts" chapter.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Pearson,
and Strommen. Voting No: None. Absent: CouncilmemberOlson.

Mayor Gamec noted that after the ordinance is adopted and published, it will be effective in 30
clays.

Councihncmbcr Strommen asked the Council to address the contamination and lead issues that
have bccn raised. She asked Mr. Peterson if he will seek a certificate of completion from the
MPCA.

Mr. Joc Ottcn, i:~;nvironmental Engineer with Wenk Associates and formerly supervisor of the
VIC program with the WCA, stated he is familiar with that issue. He advised the contamination
has been characterized so the MPCA has given approval to a response action plan relative to no
I'urthcr action for the soil. What has not yet been accomplished, but is intended, is groundwater
qualification which will qualify the developer for a certificate of completion. Mr. Otten stated he
docs not anticipate lead contamination in ground water since this lead is not of a soluble nature
but there were other uses on the site that could contribute some low level petroleum
contamination. Thc soil work is mostly complete but additional site characterization data will be
collected. Mr. Otten advised there has been recent discussion about another shooting area but
there arc not enough data points to satisfy the MPCA that enough investigation has been done.
This lead contamination is primarily shot so there is no potential to affect young children the
same way lead contamination fi'om paint in homes might. The risk factors from the MPCA are

City Council / March 22, 2005
