CASE # <br /> <br />ADOPTION OF ORDINANCE TO REPEAL AND AMEND SECTIONS OF CHAPTER <br />4.70 OF THE CITY CODE WHICH IS DEALING WITH "PUBLIC FACILITIES AND <br />IMPROVEMENTS" <br /> By: Bill Goodrich, City Attorney <br /> <br />llaekgrou nd: <br /> <br />I)uring thc Council work session of March 15, 2005, the City Council directed the City Attorney <br />and staff to work to develop language that would repeal sections of Chapter 4.70 of the City <br />Code. This section applies to any residential improved property in the City, which property has <br />urban services (sewer and/or water) available to it and which property has not been assessed for <br />benefits ol' said urban services. <br /> <br />City Council directed staff to repeal sections that require sewer and water hook-up either by sale <br />o1' property or need of repair for a private sewer and/or private water system. The City Attorney <br />has drafted a proposed ordinance for Council consideration. <br /> <br />On March 22, 2005, the City Council introduced the proposed ordinance. Since that date, staff <br />has reviewed the city code and detei~ined that section Subd. 2.a. of Subsection 4.40.07 should <br />also bc repealed. The ordinance now presented for adoption contains that additional subdivision <br />repeak [Jnder the City Charter, the ordinance is now eligible for adoption. <br /> <br />Council Action: <br /> <br />Motion by and seconded by to adopt Ordinance #05- to <br />amend Chapter 4 of the Ramsey City Code, which chapter is known as "Public Facilities and <br />lml~rovemcnts" chapter. <br /> <br />Roll Call Vote: <br /> <br />Councilmember Pearson <br />Councilmember Elvig <br />Councilmember Strommen <br />Councilmember Cook <br />Councilmember Olson <br />Councilmember Jeffrey <br />Mayor Gamec <br /> <br />Reviewed by: <br /> <br />City Administrator <br /> <br /> <br />
