ORDINANCE NO. 05 - <br /> <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />AN AMI';NDMENT TO CHAPTER 4 OF THE RAMSEY CITY CODE, WHICH CHAPTER IS <br />I(NOWN AS THE "PUBLIC FACILITIES AND IMPROVEMENTS" CHAPTER OF THE <br />CITY CODE. <br /> <br />AN ORDINANCE AMENDING SECTION 4.70 OF THE CITY CODE WHICH SECTION IS <br />15NTIT[,t';D "IIMPLEMENTATION OF CHAPTER 8.6 OF THE CITY CHARTER". <br /> <br />Thc City o£ Ramsey Ordains: <br /> <br />SECTION 1. AMENDMENT <br /> <br />A. Subsection 4.40.07 entitled "Water and Sewer Utilities" of Chapter 4 of the City Code is <br />amended by REPEAL of the following subdivision: <br /> <br />Subd. 2. <br /> <br />Application for Service <br /> <br />a. The owner of a dwelling, building, other structure or property where cesspools or <br />septic tanks have been in existence prior to construction of a sanitary sewer shall connect <br />with the public sanitary sewer when such cesspools and septic tanks are in need of repair, <br />reconstruction or pumping, or within two (2) years of the date that municipal sanitary <br />sewer service is available to the premises, which is first to occur. Any property owner <br />who can demonstrate to the Council that hookup to municipal sewer is not feasible due to <br />distance, to topography or pending land use change shall not be required to hookup at that <br />specific time. However, hookup may be required in the future upon change of <br />circumstances. <br /> <br />B. Section 4.70, entitled "Implementation of Chapter 8.6 of the City Charter" of Chapter 4 <br />()['the C ily Code is amended by REPEAL of the following subsection: <br /> <br />4°70.05 Sale of Property. Upon the sale or transfer of title of a residential <br />improved property by a property owner who elected to remain on a functional <br />private sewer and/or water system, and whose property was therefore not assessed <br />for City utilities, the City may levy an assessment on said property in an amount <br /> <br />C. t'aragraph b. of subsection 4.70.04 entitled "Repair of Systems" of Chapter 4 of the City <br />Code is AMENDED to provide as follows: <br /> <br />4.70.04 <br /> <br /> b. <br /> <br />Repair of Systems <br /> <br />An existing home which is serviced by a non-functional private <br />sewer and/or private water system shall be required to either (1) <br />connect to the City's sewer system if the home's sewer system is <br /> <br /> <br />
