Background: <br /> <br /> ADOPT ORDINANCE TO REZONE CERTAIN PROPERTY <br />FROM R-2 MEDIUM DENSITY RESIDENTIAL TO TOWN CENTER-4A; <br />CASE OF BRIGHTKEYS, INC. <br /> By: Amy Geisler, Associate Planner <br /> <br />CASE # 16 <br /> <br />Brightkeys, Inc. has requested that the City consider rezoning a portion of their property from R-2 Medium <br />Density Residential to Town Center - 4a in order to allow for a subdivision of their land. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Site location map <br /> b) Preliminary Plat of Town Center Gardens 3rd Addition <br /> c) City Council meeting minutes dated December 14, 2004 <br /> d) Proposed Ordinance <br /> <br />Notificatio.: <br /> <br />State statute requires that property owners within 350 feet of the subject property be notified of the public <br />heari~g. Notice was sent out to property owners within 700 feet of the Subject Property. <br /> <br />Observations: <br /> <br />The rezoning request is for the portion of Town Center Gardens 3rd Addition between Bunker Lake Blvd. and <br />t47~' Lane NW. The applicant applied for a Comprehensive Plan Amendment to change the subject <br />property's land use designation from Medium Density Residential to Mixed Use; this request was approved <br />by the City Council on December 14, 2004. The Metropolitan Council has also approved the request. <br /> <br />Along with the Comprehensive Plan Amendment request, the property must be rezoned to Town Center - <br />TC-4a to accommodate the proposed preliminary plat. The City Council introduced the ordinance to approve <br />this request on December 14, 2004; the ordinance is now ready for adoption. <br /> <br />Reconnnendation: <br /> <br />Staff recommends adoption of the ordinance to rezone the subject property. <br /> <br />Council Action: <br /> <br />Motion by Cotmcilmember ~ and seconded by Councilmember to adopt Ordinance #05- to <br />rezone the subject property from R-2 Medium Density Residential to TC-4a, based on the findings of fact. <br /> <br />Reviewed by: Copies to: <br />Community I)eveloprnent Director City Attorney <br /> <br />CC: 4/12/I}5 <br /> <br /> <br />
