CC CASE: <br /> <br />ADOPT POLICY ON RIGHT-OF-WAY ENCROACHMENT FOR BUILDINGS <br />IN RAMSEY TOWN CENTER <br /> By: Leonard Linton, Civil Engineer II <br /> <br />Background: <br /> <br />Thc Ramsey Town Center retail areas have been set up to have the buildings close to the <br />right of way lines. The zoning code specifically requires most buildings to be within 0 - <br />5 feet of the fi'ont lot line to create a more urban look to the development. <br /> <br />Observation: <br /> <br />Staff has researched the policies of Minneapolis, St Paul and Hopkins since they all have <br />areas with canopies projecting into the right-of-way. <br /> <br />The <br /> <br />Minneapolis requirements are summarized below: <br /> A permit is required for any portion of a building that encroaches into the right-of- <br /> way either above or below ground. <br /> Insurance must be maintained by the owner of the building while the encroachment <br /> is in place, a lapse in insurance will be grounds for initiating the process of revoking <br /> the permit and removing the encroachment. <br /> Footings and foundations may encroach a maximum of 3 feet provided they do not <br /> interfere with sewers, pipes or conduits. <br /> Doors may not project more than 4 inches when fully open. <br /> Awnings, canopies and marquees must meet specific structural design requirements. <br /> <br />t lopkins requires a conditional use permit for all canopies and insurance naming the city <br />as an insured must be maintained while the canopy is in place. St. Paul requires a permit <br />t'or right-of-way encroachments excluding awnings. <br /> <br />The area between the back of curb and the right-of-way in Ramsey Town Center has <br />planter boxes, boulevard trees, light poles and sidewalks above ground with a duct bank <br />for underground utilities. <br /> <br />The Public Works Committee discussion focused on the need for the policy and how to <br />implement the policy. The minutes of the meeting are attached. They agreed a policy is <br />necessary and asked staff to draft a policy for full council review. <br /> <br />Staff' has prepared the attached policy regarding encroachments for buildings in Ramsey <br />Town Center. The policy allows above ground encroachments with a permit from the <br />city. Underground encroachments up to 1 foot are permitted since the space between the <br />back of curb and the right-of-way line is limited and there are multiple utilities and <br />£eatures that need to be installed to meet the design guidelines adopted for Ramsey Town <br /> <br /> <br />
