SUBJECT <br /> <br />Policy on Right-of Way Encroachment for Buildings in Ramsey Town Center <br /> <br />POLICY STATEMENT <br /> <br />The City of Ramsey has worked with the Ramsey Town Center, LLC to create a pedestrian friendly retail <br />environment by requiring the fi'ont of buildings to be within 0-5 feet of the front property line. Canopies <br />and axvnings will extend into the public right-of-way due to the proximity of the buildings to the property <br />li nc. This policy addresses the procedure for approving these encroachments. <br /> <br />BACKGROUND <br /> <br />Thc area between the back of curb and the right-of-way will have sidewalks with boulevard trees, <br />planters, benches, light poles and sign posts above ground with sprinkler lines, root balls and a duct bank <br />for small uti lities underground. Space will be needed to maintain these facilities so it is reasonable to <br />establish pcrl'ormance guidelines for the objects that will project into the public area. This policy shall <br />apply to canopies, awnings, signs, trellises and all other building attachments that protrude into the public <br />right-o f-way. They will collectively be referred to as Canopies in this Policy. <br /> <br />COMPLIANCE REQUIREMENTS <br /> <br />Footing encroachments will not be permitted up to 1 foot into the right-of-way. All buildings shall be <br />designed to minimize the footing encroachment into the right-of-way. <br />Doors may project a maximum of 4" when fully open. <br />Tht¢ minimum vertical distance from the bottom of the protruding portion of the building to the sidewalk <br />surfitcc shall be ten (10.0) feet. <br />The n]aximuln horizontal distance that a canopy may project is 3 feet past the right-of-way line. <br />Canopies must conform to all applicable building code requirements. <br />The applicant must furnish proof of public liability insurance policy in force in the amount of five <br />hundred thousand dollars ($500,000) combined single limit, or more, for bodily injury and property <br />damage for any one encroachment granted after the effective date of this policy. The City of Ramsey <br />shall be named an additional insured on this certificate. This policy shall remain in effect while the <br />encroachment is in place. Lapse in the insurance will result in the city initiating proceedings to have the <br />encroachment removed. <br />Removal el' thc encroachment shall be at the expense of the owner whether due to change in building use <br />or when ordered by the city upon lapse of insurance. The city may initiate billing and special assessment <br />procedures to recover the reasonable costs of removal if the owner fails to act in a timely manner after <br />being dircctcd by the city to remove the encroachment. <br />All encroachments shall be maintained in a safe condition at the expense of the owner. <br /> <br /> <br />
