CC Regular Session 5. 7. <br />Meeting Date: 03/10/2020 <br />By: Bruce Westby, Engineering/Public <br />Works <br />Information <br />Title <br />Adopt Resolution #20-043 Postponing Public Hearing for Puma Street Improvements, Improvement Project #20-04 <br />Purpose/Background: <br />Purpose: <br />The purpose of this case is to adopt Resolution #20-043 postponing the Public Hearing for Puma Street <br />Improvements, Improvement Project #20-04, until March 24, 2020. <br />Background: <br />On February 24, 2020, a Public Hearing was called for the Puma Street Improvements project, Improvement <br />Project #20-04. As required by Minnesota Statute Chapter 429, a notice of Public Hearing was published twice in <br />the City's official newspaper, the Anoka Union Herald, on Friday, February 28th, and Friday, March 6th. Minnesota <br />Statute Chapter 429 also requires that notices be mailed to all benefiting property owners proposed to be specially <br />assessed for the improvements, which for this project includes two property owners, Captsone Homes and AKM <br />Farms/Paxmar. Unfortunately, notice was not mailed to the property owners so the Public Hearing must be <br />postponed until March 24, 2020 to allow notices for the postponed public hearing to be published in the City's <br />offical newparer, and to be mailed to all benefiting property owners. This will ensure that the Chapter 429 process is <br />being strictly followed, and that benefiting property owners will have no grounds for objecting to the process <br />followed in assessing them for a portion of the the improvements. <br />Notification: <br />As required by State Statute Chapter 429, Public Hearing notices will be published twice in the City's official <br />newspaper, the Anoka Union Herald, on March 13 and March 20, 2020, and notices will be mailed to all benefiting <br />property owners not less than 10 days before the hearing. <br />Observations/Alternatives: <br />Alternatives: <br />Alternative 1 - Adopt Resolution #20-043 postponing the Public Hearing for Puma Street Improvements, <br />Improvement Project #20-04, until March 24, 2020. <br />Funding Source: <br />Publication costs are estimated at $180. These costs will be paid as indirect project costs, which are eligible <br />assessment costs. <br />Recommendation: <br />Staff recommends Alternative 1. <br />Action: <br />Adopt Resolution #20-043 postponing the Public Hearing for Puma Street Improvements, Improvement Project <br />#20-04, until March 24, 2020. <br />
