• <br />• <br />Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -12 -342 <br />RESOLUTION CALLING FOR A BINDING SPECIAL ELECTION ON THE <br />INCLUSION OF DENSITY TRANSITION STANDARDS <br />and <br />WHEREAS, the citizens of Ramsey petitioned for density transition standards; and <br />WHEREAS, an election was held to determine if a requirement for density transition <br />standards should be included in the Ramsey City Charter; and <br />WHEREAS, the citizens overwhelmingly approved the inclusion of the requirement; and <br />WHEREAS, the City has employed consultants to draft an ordinance to implement the <br />charter amendment; and <br />WHEREAS, the Planning Commission has reviewed and modified the draft ordinance; <br />WHEREAS, the Planning Commission has taken public input as required by law; and <br />WHEREAS, the City Council has reviewed and modified the draft ordinance; and <br />WHEREAS, the City Council was divided on its passage; and <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) The City of Ramsey shall, on January 3, 2001, or as soon as permitted by law, hold a <br />binding special election to determine if the density transition ordinance subjected to a <br />vote of the City Council on December 12, 2000, shall be approved. <br />2) The City of Ramsey shall comply with all special election requirements and shall proceed <br />to hold such an election unless such action is enjoined by a court of competent <br />jurisdiction. <br />3) If the City of Ramsey is enjoined from holding a binding election on the density <br />transition ordinance by a court of competent jurisdiction the City of Ramsey shall <br />proceed with an advisory election as soon as legally possible. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Connolly, and upon vote being taken thereon, the following voted in favor thereof: <br />Councilmember Hendriksen <br />Councilmember Connolly <br />Councilmember Zimmerman <br />
