• <br />• <br />Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -12 -329 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0544 TO REZONE CERTAIN <br />PROPERTY FROM B -1 BUSINESS TO B -2 BUSINESS <br />WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 of the Ramsey. City Code; and <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That Phoenix Enterprises LLC and Lyndale Terminal Company, hereinafter referred to as <br />"Applicants ", have properly applied to rezone certain property from B -1 Business to B -2 <br />Business. <br />2. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on December 5, 2000, and that said public hearing was properly advertised <br />and that the minutes of said public hearing are hereby incorporated by reference. <br />3. That the property proposed to be rezoned is legally described as follows: <br />4. 1.4 acres of the northerly portion of Outlot C Rivers Bend 3r Addition, Anoka County, <br />State of Minnesota <br />( "the Subject Property "). <br />5. That the total area of the Subject Property to be rezoned is approximately 1.4 acres in <br />size. <br />6. That the Subject Property is part of a larger parcel that is currently zoned B -1 Business. <br />7. That convenience stores are a permitted use in the B -1 Business District; convenience <br />stores with gasoline sales is a permitted use in the B -2 Business District. <br />8. That the Applicants are proposing to rezone the Subject Property to B -2 Business to <br />facilitate development of it with a convenience store with gasoline sales. <br />9. That the surrounding properties to the north, west and south are zoned a combination of <br />B -1 Business, R -3 Urban Residential and Multiple Residential; the property to the east is <br />zoned R -1 Urban Residential. <br />10. That the R -1 Urban Residential property to the east was zoned Urban Multiple Business <br />for commercial and multi - family development in the 1980 Comprehensive Plan; as part <br />of a Comprehensive Plan Amendment in 1989, the City reviewed all land use categories <br />in the community and the property east of the Subject Property was rezoned to <br />commercial; in 1991, the fee owner attempted to rezone the property east of the Subject <br />Property from commercial to a combination of single and multi - family development; the <br />multi - family residential portion of the development proposal met with neighborhood <br />opposition and consequently the multi - family portion of the development was eliminated <br />and the City approved a rezoning of the property east of the Subject Property from <br />commercial to single family in 1993. <br />11. The Subject Property has been zoned for commercial uses for 20 years. <br />
