• <br />Board Member Kociscak introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -12 -320 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0543 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE FOUR (4) UNITS IN FORTY (40) ACRES <br />DENSITY RESTRICITON <br />WHEREAS, Derek Nordvik, hereinafter referred to as "Applicant ", has properly applied <br />for a Board of Adjustment variance from Section 9.20.11 of the Ramsey City Code to the 4 units <br />in 40 acres density restriction in the Rural Transition Area. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on December 5, 2000, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property and surrounding parcels are zoned R -1 Rural Residential. <br />3. That effective January 1, 1990, the City of Ramsey, as part of an expansion to the <br />Metropolitan Urban Service Area (MUSA), committed to a 4 units in 40 acre development <br />standard outside the MUSA, and amended minimum lots sizes to a range from 2.5 to 10 <br />acres. Property south of Trott Brook was established as the Rural Transition Area with a <br />minimum lot size of 2.5 acres. <br />4. That the Subject Property is in the Rural Transition Area and is 5.4 acres in size <br />5. That the Applicant has submitted a request for a variance to the 4 units in 40 acres density <br />restriction in order to convey 2.5 acres of the Subject Property to his mother. <br />6. That the Applicant's mother is confined to a wheelchair and desires to build a wheelchair <br />accessible retirement home that is close to her son for care and assistance purposes. <br />7. That the average size of the adjacent residential lots to the north is .9 acres; 2.3 acres to the <br />west and south; and the Subject Property is bounded by Armstrong Blvd. on the east. <br />8. That no similar variances have been granted since affirmation of 4 in 40 in 1990. <br />9. That the 12/21/99 draft comprehensive plan, currently under review at Metropolitan <br />Council, proposes to reduce the density restriction from 4 units in 40 acres (1 unit per 10 <br />acres on a pro -rata basis) to 1 unit in 2.5 acres in the Rural Transition Area <br />12. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />properties. <br />13. That if granted, the variance will not unreasonably increase the traffic congestion in the <br />public street. <br />14. That if granted, the variance will not permit a use that is prohibited in the R -1 Rural <br />Residential District. <br />15. That if granted, the variance will not increase the danger of fire or endanger the public <br />safety. <br />16. That if granted, the variance will not unreasonably diminish established property values <br />within the neighborhood. <br />
