• <br />• <br />Board Member Kociscak introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -12 -318 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0542 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE 20 FOOT GREEN SPACE REQUIREMENT ADJACENT <br />TO PUBLIC ROADS <br />WHEREAS, RF Development Inc. and Lyndale Terminal Company, hereinafter referred <br />to as "Applicants," have properly applied for a variance from Section 9.11.09 regarding green <br />space requirements adjacent to public roads for the proposed development on the property <br />generally located at the intersection of Xkimo Street N.W. and T.H. #47 and legally described as <br />follows: <br />Outlot C, River's Bend 3r Addition, Anoka County, Minnesota. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on December 5, 2000, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br />2. That the subject property is zoned B -1 Business and is approximately 1.4 acres in size. <br />3. That the Subject Property is surrounded by B -1 Business, Multiple Residential, R -3 Urban <br />Residential and R -1 Single Family Residential zoning. <br />4. That section 9.11.09 (Performance Standards, Screening) requires a twenty (20) foot wide <br />landscaped area adjacent to all public streets. <br />5. That in 1985, the City of Ramsey granted a 25% variance to lot sizes and setbacks in River's <br />Bend in lieu of land dedicated by the developer for the Rum River Bridge corridor and T.H. <br />#47 right -of -way. <br />6. That the 20 foot green space requirement adjacent to all public roads established in Section <br />9.11.09 is basically a parking lot setback and in accordance with the 1985 variance, is <br />reduced to a 15 foot requirement. <br />7. That the additional right -of -way dedicated in the 1980's by RF Development, Inc. to <br />Mn/DOT for future improvements to T.H. #47 widened beyond the minimum required in the <br />vicinity of Xkimo Street N.W. and T.H. #47. <br />
