• Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #00 -11 -306 A RESOLUTION ADOPTING FINDING OF FACT #0540 RELATING TO A REQUEST FROM CATHLEEN ARTMAN FOR A CONDITIONAL USE PERMIT TO OPERATE A MASSAGE THERAPY HOME OCCUPATION LOCATED AT 14651 NEON STREET NW. WHEREAS, the City of Ramsey received an application from Cathleen Artman for a conditional use permit to operate a massage therapy within the dwelling on the property generally known as 14651 Neon Street and legally described as follows: Lot 10, Block 5, Chestnut Ridge 2 "d , Anoka County, Minnesota (the "Subject Property ") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: • 1. That on October 11, 2000, Cathleen Artman, hereinafter referred to as the "Applicant ", properly applied for a conditional use permit for a home occupation to establish and operate a massage therapy service in her home. 2. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on November 6, 2000, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject Property is zoned R -1 Urban Residential. 4. That the Subject Property is approximately .3 acres in size. 5. That a massage therapy is not a permitted use in the R -1 Urban Residential District. 6. That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property, that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling, and the operation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. 7. That the Applicant will reside at the location of the proposed home occupation.
