• <br />9. That the second dwelling will be harmonious with and in accordance with the specific <br />objectives of the Comprehensive Plan. <br />10. That the second dwelling will not adversely impact traffic in the area. <br />11. That the second dwelling will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare, provided that all <br />necessary improvements are made to comply with City Code and a Certificate of <br />Occupancy is received. <br />12. That the second dwelling will not substantially adversely impair the use, enjoyment, or <br />market value of any surrounding property. <br />13. That the second dwelling will not be hazardous or disturbing to existing or future <br />neighboring uses. <br />14. That the second dwelling will be served adequately by public facilities and services such as <br />highways and streets. <br />15. That the second dwelling will not create excessive additional requirements at public cost <br />for public facilities and services, and it will not be detrimental to the economic welfare of <br />the community. <br />16. That the second dwelling will not involve activities and uses that will be detrimental to any <br />persons, property, or the general welfare by reason of excessive production of traffic, noise, <br />smoke, fumes, glare, or odors. <br />17. That to deny the use of the second structure as a dwelling unit would be a hardship to the <br />existing property owners as they purchased the property in its current partially complete <br />condition as a dwelling unit and the use most feasible in its current condition is as a <br />dwelling. <br />18. That the Council finds that this is a unique circumstance and the granting of a conditional <br />use permit shall not be deemed a precedent to allow new construction of two principal <br />structures on a parcel in violation of City Code. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Connolly, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Hendriksen <br />Councilmember Connolly <br />Councilmember Anderson <br />Councilmember Zimmerman <br />RESOLUTION #00 -10 -279 <br />Page 2 of 3 <br />
