Board Member Dempsey introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -10 -260 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0534 RELATING TO A <br />REQUEST FOR A VARIANCE TO MINIMUM LOT SIZE IN THE SINGLE FAMILY <br />RURAL SERVICE AREA <br />WHEREAS, David and Grace Ibach, hereinafter referred to as "Applicants ", have <br />properly applied for a Board of Adjustment variance from Section 9.20.11 of the Ramsey City <br />Code to reduce the size of their parcel in the Rural Service Area. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on October 3, 2000, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property and surrounding parcels are zoned R -1 Rural Residential. <br />3. That effective January 1, 1990, the City of Ramsey, as part of an expansion to the <br />Metropolitan Urban Service Area (MUSA), committed to a 4 units in 40 acre development <br />standard outside the MUSA, and amended minimum lots sizes to a range from 2.5 to 10 <br />acres. Property north of Trott Brook was established as the Rural Service Area with a <br />minimum lot size of 10 acres. <br />4. That the Subject Property is in the Rural Service Area and is 10 acres in size. <br />5. That the driveway for the adjacent parcel north of the Subject Property lies partially on the <br />Subject Property and has existed as such for approximately 30 years. <br />6. That the Applicants have submitted a request for a variance to the minimum lot size in <br />order to convey 1.4 acres of the Subject Property to the adjacent parcel to the north in order <br />that the driveway for the parcel to the north will be located entirely on the parcel to the <br />north. <br />7. That the reduction in minimum lot size will not result in the creation of any new lots. <br />8. That if the variance to minimum lot size is granted, the Subject Property and the parcel to <br />the north will maintain compliance with the 4 unites in 40 acres density restriction. <br />• 9. That the special conditions causing the practical difficulty, namely the revised lot sizes and <br />density restrictions occurring in 1990. do not result from the actions of the Applicants. <br />
