Motion by Board Member Johnson, seconded by Board Member Watson to approve the minutes <br />as presented. <br /> <br />Motion carried. Voting Yes: Vice Chairperson Van Scoy, Board Members Johnson, Shepherd, <br />and Watson. Voting No: None. Absent: Chairperson Nixt, Board Member Brauer. <br /> <br />I'UBI,IC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance on to Minimum Lot Width and Lot Area in the <br />Critical River Overlay District; Case of Darrell Anderson <br /> <br />Assistant Community Development Director Frolik advised that the Critical River Overlay <br />District of the Ramsey City Code states that lots that are sub-standard in width and area by <br />today's standards are not eligible for development if it is under the same ownership as one of the <br />adjacent parcels. She indicated that Donald and Molly Anderson own Lot 1, Block 1, Bowers <br />Mississippi Acres 2"d Addition and Lot 33 Bowers Mississippi Acres. She stated their home is <br />currently on Lot 33, while Lot 1 Block 1 remains vacant. <br /> <br />Assistant Community Development Director Frolik advised that the Andersons intend to sell <br />both lots to help offset family medical expenses. She indicated that since Lot 1, Block 1, does <br />not contain a principal dwelling and is currently owned by the Andersons, it is necessary for them <br />to obtain a variance to lot width and area to render it a buildable lot. She stated Staff <br />recommends approval, and if the variance is approved, it will be sent to the DNR for <br />certification. <br /> <br />Darrell Anderson, son of the owners, indicated his parents purchased both lots in the early <br />1960's, and built on one of the lots. He stated that the second lot was intended for investment, as <br />they had a handicapped child to provide for. He indicated that both of his parents have since <br />developed scrions illnesses, and the family very much needs the variance to sell the lot and <br />provide for their medical needs and trusts for his sisters. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson to close the public <br />hc~tring. <br /> <br />Motion carried. Voting Yes: Vice Chairperson Van Scoy, Board Members Johnson, Shepherd, <br />and Watson. Voting No: None. Absent: Chairperson Nixt, Board Member Brauer. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson to adopt Resolution <br />#05-02-033 adopting Findings of Fact #0715 favorable to the applicant relating to Darrell <br />Anderson's request for a variance to Section 9.21.07 of the Ramsey City Code regarding lot area <br />and lot width, contingent upon DNR certification, and completing a second P1N request at the <br />el]ices of Anoka County. <br /> <br />Motion carried. Voting Yes: Vice Chairperson Van Scoy, Board Members Johnson, Shepherd, <br />and Watson. Voting No: None.
