The opening between the bottom of the fence and the <br />ground or other surface shall not be more than three (3) inches. <br /> <br />All outdoor fence or wall openinus or outdoor points of entry <br />into the pool area shall be equipped with self-closin~ and self- <br />tatchina devices. <br /> <br />(b) All above-ground swinnninu pools that have a minimum side- <br /> <br />wall hei<ht of tbttr (4') l~et need not be fen_ced, but shall have <br />removable steps, which steps shall be removed when the <br />swimming4 pool is unattended. In the event that an accessory <br /> <br />deck to the swimming pool is consWucted..which is adjacent to <br />any part of the swimming, pooL said deck shall include, on its <br />entire outside perimeter, a 36-inch hiuh ~uard rail. The guard <br />mil shall be constructed so that no open space w/thin it is wider <br />than six (63 inches. <br /> <br />(c) All outdoor spas shall have either a_ fence as described in <br /> par. agraph (a) above, or a secured cover. <br /> <br />c, Noise. <br /> <br />The swimming pool of spa shall be desit~ned, constructed and sited <br />in such a way as to I/mit noise generated by its mechanical <br />equipment, so ~s not to .create a nuisance and/or affect the <br />reasonable use and enjoyment of adjacent property owners. <br /> <br />The swimming pool and/or spa shall be sited on the parcel so that <br />its mechanical equipment, including heating and filtering <br />..equipment, is located at least thirw (30) feet fi'om the inhabited <br />portion of neighborblg residential structures. <br /> <br />d. Pool Walkway Deck and Deck Drains. Unobstructed deck areas not <br /> <br />less than forW-eit~ht (48) inches wide shall be provided to extend <br />entirely around each in-m'ound swimming pool.
