APPROVE AGENDA

Commissioner Ebel stated that there are new Councilmembers since we last discussed a City
Administrator position versus a City Manager position. She suggested the Charter invite the new
Council in for a discussion before anything new is discussed.

Chair Vogt agreed that was a good idea. We need some time ourselves to have some discussion
and discovery. City Council will take our influence and will talk about it but it's up to them if
they want to take our suggestion. He added there could be some citizen input too.

Commissioner LaMere stated that while we have a resource here (referring to Rylee Retzer of
the League of Minnesota Cities), we can ask questions during Case # 1.

Chair Vogt stated he has a friend who works for Stillwater who was involved in this and we
could have her come in to talk to the Commission also if we like.

Consensus was to approve the agenda.

COMMISSION BUSINESS:

Case #1: Presentation by Rylee Retzer, League of Minnesota Cities

City Clerk Thieling introduced Rylee Retzer, staff attorney in the research department for the
League of Minnesota Cities.

Ms. Retzer presented an overview of charter commissions in general, the functions of charters,
and how amendments happen. She reported there are 853 cities in Minnesota and 107 of them
are Charter cities. Ms. Retzer also reported on legislation that took place in 2004 discontinuing
term limits for Charter Commissions. She added that a City may specify that no
Councilmembers can be a Charter Commissioner.

Commissioner Simenson inquired about cities favoring Manager versus Administrator form of
government.

Ms. Retzer stated she will send some information on that subject to be distributed to the Charter
Commission. She suggested looking at other City's job descriptions to see differences and added
that Kevin Frazell from the LMC has a lot of experience with administrator versus manager
discussions. He may have some good policy advice.

Case #2: Appoint Chair and ViCe Chair for Commission

With new legislation, it was noted that Mr. Vogt did not have to end his term with the Charter
Commission.

Motion by Commissioner Ebel and seconded by Commissioner LaMere to invite Tim Vogt to
remain a member of the Charter Commission and' to submit a letter stating same to the Judge.

-2-

Charter Commission - January 20, 2005
