• <br />Board Member Kociscak introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -09 -226 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0530 RELATING TO HAROLD <br />AND NANCY BOYUM'S REQUEST FOR A VARIANCE TO STRUCTURE SETBACK <br />FROM THE ORDINARY HIGH WATER MARK IN THE CRITICAL RIVER <br />OVERLAY DISTRICT <br />WHEREAS, Harold and Nancy Boyum, hereinafter referred to as "Applicants ", have <br />properly applied for a Board of Adjustment variance from Section 9.21.07 of the Ramsey City <br />Code to develop a dwelling on the following legally described property that will encroach on the <br />setback from ordinary high water mark. <br />That part of Lot 30, Bowers Mississippi Acres, Anoka County, Minnesota, according to <br />the recorded plat thereof, which lies northwesterly of the following line and its <br />extensions. Said line is described as follows: Beginning at the most northerly corner of <br />Lot 31 of said Bowers Mississippi Acres, thence southwesterly along the northwest line <br />of said Lot 31 a distance of 182.00 feet; thence southwesterly deflecting to the right 30 <br />degrees 00 minutes 00 seconds a distance of 36.55 feet; thence southwesterly deflecting <br />to the left 30 degrees 00 minutes 00 seconds; a distance of 90.69 feet; thence southerly <br />deflecting to the left 30 degrees 00 minutes 00 seconds, a distance of 36.55 feet to the <br />northwesterly line of said Lot 31; thence southwesterly along the northwesterly line of <br />said Lot 31 to the shoreline of the Mississippi River and said line there terminating. <br />(the "Subject Property ") <br />NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on September 5, 2000 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Rural Residential and is approximately .8 acres in <br />size. <br />3. That the surrounding parcels are also zoned R -1 Rural Residential. <br />4. That the Subject Property is located in the Wild and Scenic and the Critical River Overlay <br />Districts. <br />5. That Section 9.21.07, Subd. 1.a of the Ramsey City Code establishes a structure setback of <br />35 feet from bluff or 200 feet from ordinary high water mark, whichever is greater. <br />
