• Board Member Kociscak introduced the following resolution and moved for its adoption: RESOLUTION #00 -09 -226 A RESOLUTION ADOPTING FINDINGS OF FACT #0530 RELATING TO HAROLD AND NANCY BOYUM'S REQUEST FOR A VARIANCE TO STRUCTURE SETBACK FROM THE ORDINARY HIGH WATER MARK IN THE CRITICAL RIVER OVERLAY DISTRICT WHEREAS, Harold and Nancy Boyum, hereinafter referred to as "Applicants ", have properly applied for a Board of Adjustment variance from Section 9.21.07 of the Ramsey City Code to develop a dwelling on the following legally described property that will encroach on the setback from ordinary high water mark. That part of Lot 30, Bowers Mississippi Acres, Anoka County, Minnesota, according to the recorded plat thereof, which lies northwesterly of the following line and its extensions. Said line is described as follows: Beginning at the most northerly corner of Lot 31 of said Bowers Mississippi Acres, thence southwesterly along the northwest line of said Lot 31 a distance of 182.00 feet; thence southwesterly deflecting to the right 30 degrees 00 minutes 00 seconds a distance of 36.55 feet; thence southwesterly deflecting to the left 30 degrees 00 minutes 00 seconds; a distance of 90.69 feet; thence southerly deflecting to the left 30 degrees 00 minutes 00 seconds, a distance of 36.55 feet to the northwesterly line of said Lot 31; thence southwesterly along the northwesterly line of said Lot 31 to the shoreline of the Mississippi River and said line there terminating. (the "Subject Property ") NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on September 5, 2000 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That the Subject Property is zoned R -1 Rural Residential and is approximately .8 acres in size. 3. That the surrounding parcels are also zoned R -1 Rural Residential. 4. That the Subject Property is located in the Wild and Scenic and the Critical River Overlay Districts. 5. That Section 9.21.07, Subd. 1.a of the Ramsey City Code establishes a structure setback of 35 feet from bluff or 200 feet from ordinary high water mark, whichever is greater.
