• <br />• <br />WHEREAS, the real property described below (the "Subject Property ") can feasibly be <br />connected to municipal utilities and has good development characteristics for development as an <br />industrial park; and <br />WHEREAS, pursuant to Minn. Stat. §469.124, et. seq. (the "Development District Act ") the <br />City has established Development District No. 1 (the "Development District ") by resolution duly <br />adopted, and subsequent resolutions, the City adopted the Development Program and approved <br />creation of the Development District in order to carry out the Development Program; and <br />WHEREAS, the purpose of the State Legislature in establishing City Development Districts, is <br />to promote new development in areas of a City that are already built up in order to provide <br />employment opportunities, to improve the tax base, and to improve the general economy of the State; <br />and <br />WHEREAS, Minn. Stat. §469.124, in order to accomplish said statute's purpose, authorizes <br />cities, amongst other things, to develop a program for improving a Development District of the City to <br />provide impetus for commercial development, to increase employment, to provide off - street parking to <br />serve the shoppers and employees of the district to provide open space relief within the District, to <br />protect pedestrians from vehicle traffic and inclement weather; and <br />WHEREAS, Minn. Stat. §469.124 further declares that the actions to assist the implementation <br />of the above development programs authorized by said statute are a public purpose and that the <br />execution and financing of these programs are a public purpose; and <br />IP WHEREAS, the City, pursuant to Minn. Stat. §469.126, has the authority to acquire land by <br />eminent domain within its Development Districts in order to carry out the Development Program; and <br />WHEREAS, the City has authority to acquire real property for public purposes by eminent <br />domain pursuant to Minn. Stat. Chapter 117 and pursuant to its City Charter; and <br />WHEREAS, the City has the right to acquire the real property prior to the filing of an award <br />by the Court appointed commissioners, pursuant to Minn. Stat. §117.011 and §117.042; and <br />WHEREAS, the City finds and declares that it is in the public interest to acquire title to and <br />possession of the Real Property prior to the filing of an award by the Court appointed commissioners; <br />and <br />WHEREAS, the legal descriptions for the various parcels are as follows: <br />Parcel A: Anoka County PIN: 34- 32 -25 -21 -0012 <br />Lot 1, Auditor's Subdivision 31, according to the map or plat on file and of record in the office of the <br />County Recorder in and for Anoka county, Minnesota, except that part lying southerly and Easterly of <br />the following described line: <br />RESOLUTION # 00 -06 -196 <br />Page 2 of 5 <br />
