• <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -07 -166 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0526 RELATING TO A REQUEST <br />FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE NEARER THE <br />FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />WHEREAS, Michael and Anita Kucala, hereinafter referred to as "Applicant," have <br />properly applied for a variance from Section 9.11.02 of the Ramsey City Code to construct a <br />garage nearer the front property line than the principal structure on the property generally known <br />as 15541 Zirconium Street N.W. Avenue and legally described as follows: <br />Lot 16, Block 2, High Point, Anoka County, Minnesota <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on July 10, 2000, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br />• 2. That the subject property is zoned R -1, Rural Residential and is approximately 4.5 acres in <br />size. <br />3. That the subject property is surrounded by R -1 Rural Residential zoning developed with <br />single family homes. <br />4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of accessory <br />structures nearer the front property line than the principal structure. <br />5. That the principal structure on the subject property is approximately 234 feet from the <br />property line. <br />6. That the Applicants are proposing to construct a garage approximately 210 feet from the <br />property line. <br />7. That the City Code allows for a total of 2864 square feet of garage and accessory buildings <br />on the subject property; the proposed garage is 576 square feet in size and the garage attached <br />to the principal structure which is 552 square feet, for a total of 1128 square feet of garage <br />and accessory building space. <br />8. That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely the side and rear yards contain wetlands and <br />significant mature tree growth and that placement of the proposed structure in compliance <br />with applicable provisions of City Code is infeasible. <br />
