Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION NO. 00-05-132 <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0524 AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS <br />WHEREAS, the Ramsey City Council adopted Resolution No. 00 -05 -131 adopting <br />Findings of Fact #0524 for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On May a Conditional Use Permit ( "CUP ") was issued by the City of Ramsey ( "City ") to <br />Eric Thomsen ( "Permit Holder ") for grading operations on the property legally described <br />as follows: <br />That part of the Southwest Quarter of the Southwest Quarter of Section 2, Township 32, <br />Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, <br />subject to easement of record; <br />-and- <br />The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, <br />Anoka County, Minnesota, lying southerly of County Road #63. <br />( "Subject Property: ") <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br />1. This permit shall expire two (2) years from the date of commencement of operations and <br />the Permit Holder shall be responsible for providing the City with at least 48 hours <br />advance notice of the date of commencement of operations, However, the total time <br />frame from date of permit approval through operations shall not exceed the three (3) year <br />maximum time frame established by City Code. <br />2. All grading operations shall be conducted in accordance with the grading plan dated <br />January 14, 1997, Revision Date March 17, 1997, prepared by E.G. Rud & Sons, Inc. <br />The proposed area to be graded is roughly nine (9) acres in size. Excavation shall be <br />confined to a five (5) acre area at any time. Continuation of grading shall require finished <br />grade areas to be restored with six (6) inches of topsoil, seed and disc anchored mulch. <br />ill 3. All equipment used for grading and hauling operations shall be maintained and operated <br />in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish <br />shall be removed from the work site regularly. <br />
