° 1- 3a -aS -3 - odcD5/ <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -05 -113 <br />A RESOLUTION DECLARING TERMS OF VARIANCE TO THE REAR RIVER <br />SETBACK REQUIREMENTS IN THE CRITICAL RIVER OVERLAY DISTRICT. <br />WHEREAS, on May 2, 2000, the Ramsey Board of Adjustment issued a variance from <br />Section 9. 21.07 of the Ramsey City Code to permit the construction of an addition on the <br />existing lawful, non - conforming principal structure on the property generally known as 14230 <br />Bowers Drive N.W. and legally described as follows: <br />Lot 7, Block 1, Bower's Mississippi Acres 3` Addition, Anoka County, Minnesota <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. Based on Findings of Fact #0520, a variance to the Mississippi River setback requirement <br />from ordinary high water mark is hereby granted in order to construct an addition on the <br />principal structure on the Subject Property in accordance with the site plan received at the <br />City on March 3, 2000, attached hereto as Exhibit A. <br />2. The dwelling and the addition shall maintain a minimum setback of 100 feet from the <br />ordinary high water mark and 69 feet from the bluff line. <br />3. The dwelling and the addition shall not exceed 35 feet in height. <br />4. That no other structures or additions shall be constructed in the reduced river setback. <br />1520689 <br />5. This variance shall become null and void if it is not initiated within 12 months of the date of <br />approval. The property owner may petition for an extension of time in which to complete the <br />variance. Such extension shall be requested in writing and filed with the City at least 30 days <br />before the expiration date of the original variance. <br />6.
