• <br />9. That Section 9.21.07 (Critical River Overlay District Development Standards) provides for <br />the expansion, change of use, renewal of existing permit or building permit if the applicant <br />can provide and maintain adequate screening of the structure from the water, expansion of <br />existing structures shall be in a direction away from the riverfront, and that the public's <br />ability to view the river and river corridor from existing public streets shall not be further <br />degraded by the proposed activity. <br />10. That the applicant is proposing to maintain the existing vegetative screening that is presently <br />located on the property, the addition will not be any closer to the river than the principal <br />structure, and the ability to view the river will not be adversely degraded by the proposed <br />addition. <br />11. That if granted, the variance will not allow any use that is neither a permitted or a conditional <br />use in the land use district in which the Subject Property is located. <br />12. That there are exceptional circumstances unique to the Subject Property which were not <br />created by the Applicant; namely, the establishment of the Critical River regulations in 1985 <br />rendered the Subject Property lawful, nonconforming. <br />13. That the strict enforcement of Section 9.21.07 of the Ramsey City Code will/will not result in <br />unnecessary hardship to the Applicant. <br />14. That if granted, the variance is not contrary to the purpose and intent of Section 9.21.07 of <br />the Ramsey City Code. <br />15. That if granted, the variance will not alter the essential character of the area. <br />16. That if granted, the variance will not adversely impact the degree of public health, safety and <br />general welfare provided for in the Ramsey City Code <br />17. That if granted, the variance will not unreasonably increase the congestion in the public <br />street. <br />18. That if granted, the variance will not unreasonably diminish established property values <br />within the neighborhood. <br />19.
