Councilmember Hendriksen introduced the following resolution and moved for its
adoption:
•
RESOLUTION #00 -04 -105
RESOLUTION ADOPTING FINDINGS OF FACT #0519 RELATING TO A
REQUEST FOR AN EXCEPTION TO THE DEVELOPMENT MORATORIUM
ESTABLISHED BY ORDINANCE 99 -12
WHEREAS, on April 3, 2000, the City received a written request for an
exception to the development moratorium from Fafinski, Wallrich & Roos, legal
representative for TSM Development, Inc. ( "Applicant ").
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows:
1. That the Applicants requested an exception to the development moratorium in order
to submit an application to the City to rezone Outlot A, Regency Pond ( "Subject
Property "), from I- Industrial to R -3 Urban Residential.
2. That the stated purpose of the rezoning was to facilitate development of the Subject
Property with townhomes at a proposed density of 15 units per acre.
3. The land use map in the draft comprehensive plan dated December 21, 1999 identifies
a change in the land use of the subject property from industrial to urban/rural
residential transition at a maximum density of 3 units per acre.
4. That the proposed density is inconsistent with the intent of the moratorium ordinance
and the comprehensive plan amendment.
5. That the property rights will be returned at the conclusion of the moratorium.
The motion for the adoption of the foregoing resolution was duly seconded by
Councilmember Zimmerman, and upon vote being taken thereon, the following voted in
favor thereof:
Mayor Thomas Gamec
Councilmember Terry Hendriksen
Councilmember Gerald Zimmerman
Councilmember Susan Anderson
Councilmember Margaret Connolly
and the following voted against the same:
None
