•
•
and that the minutes of said public hearing are hereby incorporated as a part of these findings
by reference.
2. That the subject property is zoned R -1 Rural Residential and is approximately 7.3 acres in
size.
3. That the subject property is surrounded by R -1 Rural Residential zoning developed with
single family homes.
4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of accessory
structures nearer the front property line than the principal structure.
5. That the principal structure on the subject property is approximately 271 feet from the street
right -of -way.
6. That the Applicants are proposing to construct a garage approximately 217 feet from the
street right -of -way line.
7. That the City Code allows for a total of 4064 square feet of garage and accessory buildings
on the subject property; the proposed garage is 1200 square feet in size; there are two smaller
accessory buildings on the property which total 256 square feet and the garage attached to the
principal structure which is 576 square feet, for a total of 2,032 square feet of garage and
accessory building space.
8. That there are special conditions applying to the Subject Property that do not generally apply
to other properties in the district; namely the side yards contain wetlands and mature tree
growth and that placement of the proposed structure in compliance with applicable provisions
of City Code is infeasible.
9. That placement of the proposed structure in compliance with applicable provisions of City
Code is infeasible.
10. That the special conditions do not result from the actions of the Applicants.
11. That literal interpretation of the provisions of City Code would deprive the Applicants of
rights commonly enjoyed by other properties in the same district, namely the right to have
additional garage space on the premises.
12. That if granted, the variance will not permit a use that is prohibited in the R -1 Rural
Residential District.
13. That the variance requested is the minimum variance which would alleviate the hardship.
14. That if granted, the variance will not impair an adequate supply of light and air to adjacent
property.
RESOLUTION #00 -04 -094
