• <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. Based on Findings of Fact #0514, a variance from minimum street frontage and lot width <br />requirements to construct a dwelling on the Subject Property is hereby granted. <br />2. This variance shall remain in effect until April 4, 2001, as long as the conditions imposed <br />herein are complied with. The Permittee may petition for an extension of time in which to <br />complete the variance. Such extension shall be requested in writing and filed with the City at <br />least 30 days before the expiration of the original variance. <br />3. The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code and no further building permits for <br />additional residential structures will be issued until such time as the Subject Property is <br />replatted in accordance with City Code and access is provided via a public road improved to <br />City standards. <br />4. The Permittee shall obtain all necessary permits prior to commencing any construction, <br />including a permit from Anoka County for access onto County Road #63. <br />5. The Permittee shall make a reasonable effort to locate the residential structure and any <br />accessory buildings constructed on the Subject Property so as not to interfere with the <br />orderly resubdivision of the Subject Property at some point in the future, and by accepting <br />this Permit acknowledges that not doing so may adversely impact the ability of the Subject <br />property to be subdivided in the future. <br />6. The Permittee shall be responsible for maintaining the driveway in a manner that will <br />facilitate access by emergency vehicles, and this shall include a minimum of a 12 foot wide <br />Class 5 surface and maintaining a tree and vegetation clearance of at least 5 feet on either <br />side of the driveway. <br />7. The Permittee agree that this variance shall be recorded in the office of the Anoka County <br />Recorder and agrees that the terms and provisions of this Agreement shall run with the land <br />and shall bind the property owner and his/her successor and assigns. <br />8. The Permittee shall be responsible for all City costs incurred in administering and enforcing <br />this variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Dempsey, and upon vote being taken thereon, the following voted in favor thereof: <br />Board member Robert Johnson <br />Board member Christopher Dempsey <br />Board member William Kociscak <br />Board member Joseph Wivoda <br />RESOLUTION #00 -04 -080 <br />Page 2 of 4 <br />
