• <br />e) The City, in its discretion, may review the splat ball use in the event it receives <br />frequent complaints about the noise level from the use. This review procedure <br />shall be the same as the conditional use permit revocation procedure of Chapter 9 <br />of the City Code. Excessive noise complaints shall be cause for revocation of the <br />splat ball use. <br />f) Because of this unique use, with no previous history in the City, the City reserves <br />the right to revoke the splat ball use in the event it finds the use is either harmful <br />to the public health and welfare and/or the quiet enjoyment and use of <br />neighboring properties. The City shall review the splat ball use two years from <br />the date hereof in order to determine its compatibility with neighboring properties <br />and upon review, determine if the use shall be permitted to continue. <br />4) Off - Street Parking: The permittee shall provide sufficient off - street parking in <br />accordance with the approved site plan and regular occurrence of on- street parking shall <br />constitute a violation of this Permit. Because of the proximity to the Mississippi River, <br />the Permittee shall also be required to provide pretreatment of run -off from the parking <br />area. <br />5) Hours of Operation: All softball, volleyball, splat ball, batting cages, horse shoe, <br />basketball, broomball, boot hockey, and roller hockey play shall cease by 10:00 p.m. and <br />the outdoor recreational area shall be cleared of all activity by 10:30 p.m. This restriction <br />shall also apply to any lighting used in this recreational area of the site. <br />6) Restroom Facilities: The use of portable restroom facilities shall be screened from the <br />general public. The screening plan is subject to the approval of the City. <br />7) Control of Operations: The permittee shall be responsible for fencing in the entire <br />outdoor recreational activity area. <br />8) Lighting: Building and parking lot lighting is subject to the approval of the City <br />Engineer, shall be arranged to deflect light away from adjoining property and public <br />streets, and bulbs emitting in excess of 3,000 lumens shall be so directed that the bulb is <br />not visible from off of the property where such light source is located. The athletic fields <br />shall be lit with Musco Sports Cluster II with level 8 glare control, or an equivalent <br />fixture that is subject to the approval of the City Engineer. All lighting used to illuminate <br />the recreational activity area shall be turned off by 10:30 p.m. <br />9) Noise: No outdoor PA system or amplified music shall be permitted. Noise levels shall <br />not exceed the limits established in the Ramsey City Code. The Permittee herein agrees <br />to provide for the establishment of deciduous tree plantings along the west property line <br />for noise absorption purposes as a result of the outdoor recreational activity area. <br />10) Signage: All signage in the outdoor recreational area shall be interior facing andnone of <br />this shall be visible from adjoining properties of the public right -of -way for a potential <br />Mississippi River bridge crossing which would impact the site. <br />RESOLUTION #00 -03 -077 <br />Page 2 of 5 <br />
