NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Applicant appeared before the Planning Commission for a public hearing <br />• pursuant to Section 9.03.04 of the Ramsey City Code on February 1, 2000, and that the <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br />2) That the subject site is approximately 15 acres in size. <br />3) That a commercial asphalt bituminous plant is not a permitted use in any district in the <br />City of Ramsey. <br />4) That the City of Ramsey issued a conditional use permit to the Applicant for an asphalt <br />production plant on July 12, 1988 that expired on January 31, 1995. <br />5) That the City of Ramsey issued another conditional use permit to the Applicant on <br />February 28, 1995 to continue operation of the asphalt production plant until March 1, <br />2000. <br />6) That on January 19, 2000, the Applicant submitted a request to renew the conditional use <br />permit for the asphalt production plant on the Subject Property. <br />7) That the Subject Property is zoned Business Warehouse and the surrounding parcels are <br />zoned either Business Warehouse or Industrial. <br />8) That the Subject Property and surrounding parcels were zoned Industrial until 1990; and <br />the asphalt plant is compatible with the surrounding uses that developed in that area, prior <br />to the City rezoning a portion of the Industrial zone to Business Warehouse. <br />9) That the asphalt plant will continue to require silos and conveyors totaling approximately <br />65 feet in height. <br />10) That the Applicant has stated that the plant will continue to process demolition concrete <br />and asphalt into aggregate for re -use. <br />11) That the use is proposed to continue in operation from approximately April through <br />November of each year and run approximately 14 hours per day, Monday through <br />Saturday. <br />12) That on June 5, 1996, the Applicant received Air Emission Permit No. 00001988 -001 <br />from the Minnesota Pollution Control Agency for a hot mix asphalt facility; this Permit <br />does not have an expiration date. <br />13) That the asphalt plant will continue to create truck traffic to and from the subject property <br />on an average of 15 trucks per hour when the plant is operating. <br />14) That the plant will continue to receive access to County Roads #116 and #57 via a thirty <br />(30) foot wide connection between the site and Basalt Street N.W., which is owned by <br />Tiller Corporation, a parent company of Commercial Asphalt. The plant is also accessed <br />via McKinley Street N.W., which is limited to incoming product only. <br />15) That history has shown that on certain occasions, accelerated work schedules required the <br />extension of hours of operation and this may continue to be the case in the future. <br />• 16) That during the term of the current conditional use permit, from February 28, 1995 to <br />March 1, 2000, the City of Ramsey has received no complaints pertaining to operations at <br />the asphalt plant. <br />17) That the proposed use will not adversely impact traffic in the area. <br />RESOLUTION #00 -03 -071 <br />Page 2 of 3 <br />
