• <br />• <br />Councilmember Connolly introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -02 -043 <br />RESOLUTION PLEDGING THAT THE CITY WILL CONTROL ACCESS ONTO THE <br />EAST RIGHT -OF -WAY OF T.H. #47 FROM 142 AVENUE NW TO XKIMO STREET <br />NW <br />WHEREAS, the T.H. #47 STP Project funding from the State of Minnesota is contingent <br />upon obtaining the right -of- access to the eastern right -of -way of T.H. #47 between 142 Avenue <br />NW and Xkimo Street NW; and <br />WHEREAS, the City of Ramsey has certain control over site access based upon the <br />zoning powers authorized in Section 9 of the City Code of Ordinances; and <br />WHEREAS, the City would prefer to utilize these access controls as opposed to <br />acquiring these access rights through eminent domain. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the City of Ramsey shall enter into a binding agreement with MnDOT pledging to <br />control right -of- access to the east side of T.H. #47 from 142 Avenue NW to Xkimo Street <br />NW. <br />2) That said agreement will commit the City of Ramsey to using its eminent domain powers if <br />necessary. <br />3) That said agreement will indemnify MnDOT from all claims brought against the State of <br />Minnesota from any action resulting from a request for access to the above - referenced <br />portion of T.H. #47. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Connolly <br />Councilmember Zimmerman <br />Councilmember Anderson <br />Councilmember Hendriksen <br />and the following voted against the same: <br />None <br />
