• • Councilmember Connolly introduced the following resolution and moved for its adoption: RESOLUTION #00 -02 -043 RESOLUTION PLEDGING THAT THE CITY WILL CONTROL ACCESS ONTO THE EAST RIGHT -OF -WAY OF T.H. #47 FROM 142 AVENUE NW TO XKIMO STREET NW WHEREAS, the T.H. #47 STP Project funding from the State of Minnesota is contingent upon obtaining the right -of- access to the eastern right -of -way of T.H. #47 between 142 Avenue NW and Xkimo Street NW; and WHEREAS, the City of Ramsey has certain control over site access based upon the zoning powers authorized in Section 9 of the City Code of Ordinances; and WHEREAS, the City would prefer to utilize these access controls as opposed to acquiring these access rights through eminent domain. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City of Ramsey shall enter into a binding agreement with MnDOT pledging to control right -of- access to the east side of T.H. #47 from 142 Avenue NW to Xkimo Street NW. 2) That said agreement will commit the City of Ramsey to using its eminent domain powers if necessary. 3) That said agreement will indemnify MnDOT from all claims brought against the State of Minnesota from any action resulting from a request for access to the above - referenced portion of T.H. #47. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Connolly Councilmember Zimmerman Councilmember Anderson Councilmember Hendriksen and the following voted against the same: None
