CC Regular Session 5. 9. <br />Meeting Date: 05/12/2020 <br />By: Chloe McGuire Brigl, Community <br />Development <br />Information <br />Title: <br />Adopt Resolution #20-091 Accepting Drainage and Utility Easement Related to Riverstone 4th Addition; Case of <br />Riverstone, LLC <br />Purpose/Background: <br />The purpose of this case is to review a request from Capstone Homes dba Riverstone, LLC (the "Applicant") to <br />grant the City a permanent 60 foot drainage and utility easement over parts of Riverstone 4th Addition (the "Subject <br />Property"). The easement is required for utilities extension to the property to the west (currently under contract for <br />the Preserve at Northfork residential subdivision) that will be recorded after the Plat. <br />Notification: <br />Notification is not required. <br />Observations/Alternatives: <br />Summary <br />The proposed easement is a standard 60 foot drainage and utility easement that meets City standards. During <br />previous discussions with City Council, the Applicant was directed to extend (stub) utilities to the property directly <br />adjacent to the west. The proposed drainage and utility easement would allow the utilities to be put in and provided <br />to the property to the west. The Applicant has worked with the adjacent property owner per request of the City <br />Council to provide the utility connection. <br />Drainage and Utility Easements <br />The drainage and utility easements are required over areas where City utilities are put in to allow the City <br />maintenance of the utilities. The easement in question is required for the health and safety of the community, and <br />Staff is supportive of granting the permanent easement on behalf of the City. Without the granting of the permanent <br />easement, utilities cannot be connected to the adjacent property. The City Council must accept these easements by <br />Resolution, and this is a standard process. <br />Funding Source: <br />The Applicant is responsible for all costs associated with review. <br />Recommendation: <br />Staff recommends adoption of Resolution #20-091 accepting a Permanent Easement related to Riverstone 4th <br />Addition. <br />Action: <br />Motion to adopt Resolution #20-091 accepting a Permanent Easement related to Riverstone 4th Addition <br />Attachments <br />Site Location Map <br />Permanent Easement Exhibit <br />
