CC Regular Session 5. 11. <br />Meeting Date: 05/26/2020 <br />By: Chloe McGuire Brigl, Community <br />Development <br />Information <br />Title: <br />Adopt Resolution #20-110 Confirming Extent of Lawful Nonconforming Rights at 14700 Armstrong Blvd. NW <br />Purpose/Background: <br />The City Code has existed since 1978 and has included provisions for nuisances and off-street parking violations. <br />The City Code at times has allowed for gravel parking surfaces in specific areas, but in reviewing aerial photos for <br />this property, it does not appear that the backyard and side yard areas have ever had gravel. It appears that the <br />property has parked junk vehicles on the grass and dirt throughout the years. Staff reviewed historic aerial photos <br />1965 - 1985 and there was no business onsite during those times. <br />Because this property is a gateway to the community and downtown Ramsey area, it is a more visible code <br />enforcement case. The property has been cordial and has been working with staff to get into compliance. The <br />property owner requested that the City review the status of lawful, nonconforming rights onsite, and stated that they <br />believe they were allowed to park on gravel onsite. <br />It does not appear that any of these rights exist onsite, but if the landowner can provide alternative information <br />proving said rights, City Staff will bring back to City Council for consideration. <br />Notification: <br />No notification required. <br />Observations/Alternatives: <br />By adopting this resolution, the Council will provide necessary direction so that Staff can take next steps in the <br />enforcement process. If the City Council desires a more in depth discussion on this topic, Staff would recommend <br />that the City Council postpone action and Staff will provide a more detailed report. <br />Funding Source: <br />Staff is handling this case as part of regular duties. <br />Recommendation: <br />Staff recommends adoption of Resolution #20-110 stating that there are no existing lawful, nonconforming rights <br />allowing parking on the grass, gravel parking pads, or other nonconforming rights onsite. <br />Action: <br />Motion to Adopt Resolution #20-110. <br />Site Location Map <br />Historical Photos <br />Resolution #20-110 <br />Attachments <br />
