Com~cilmember Cook questioned if the applicant is trying to get his business up to the present
,~;tandards of the ordinance.

('ommunity Development Director Trudgeon replied that is correct. He explained staff was not
aware of thc business being run in this location until it was brought to their attention. It was then
/bmod that the applicant would not be in compliance with the home occupation ordinance.

(~ouncilmcmber Cook asked if the only non-compliance issue is the extra employee.

(*ommunily Development Director Trudgeon replied that would be the main non-compliance
issue, but there would also be commercial vehicles stored outside that would need to be screened
to be in compliance.

:ouncilmember Cook asked what the situation would be if Mr. Guzzo were to put up screening
have one less employee within the next six months.

(;ommunity Development Director Trudgeon replied the request would be run through the
process? with the impact of the business on the neighborhood taken into consideration. The
concern of staff' is that the house is very close to the road due to the wetland, which requires the
dghbof-way to be used for vehicles to back up.

(~otmcilmember Cook asked the applicant how long he has been running this business.

Robert (;uzzo, applicant, replied he has been operating this business about two years and four
months. Two years ago when he called the City he was informed he did not need to do anything.
lie was truly made aware of this policy when staff contacted him. He stated as staff has told him
thc rules he has addressed every one of them. He previously had a large project going with
(lander Mountain in Duluth and could not store the trucks inside; however, they have purchased
;:~, large lruck that is used to store things off-site in Delano.

Councilmcmber Cook asked if it is Mr. Guzzo's intention to move this business onto a
,.;om mercial site as the business grows.

M~~. Guzzo responded in the affirmative. He stated the six-month timeline recommended by the
!'lanning Commission would require them to change their focus more on the retail businesses.
Ctm'ently their company tries to attract more of the light industrial businesses. They do more of
thc grunt work of national sign companies and have done projects like Lowes in Coon Rapids. In
thc two years this company has been in operation there are at least ten national sign companies
that are aware of their business. As far as receiving semi trucks, signs were previously received
by semis because the company was young at that time and did not even have a pole barn. They
have learned now it is a simple move, and they drop things off at the job sites.

(iouncil member Olson questioned if there will be any more semi deliveries to this site.

City Council/April 26, 2005
