Commissioner VanScoy nay <br />Chairperson Bauer aye <br />Motion carried. <br />5.05: Public Hearing: Adopt Resolution #20-085 Revoking the Conditional Use Permit <br />(CUP) for Truck Garant located at 6021 Highway 10 NW <br />Public Hearing <br />Chairperson Bauer called the public hearing to order at 11:14 p.m. <br />Presentation <br />Planning Consultant Maass presented the staff report and recommendation for the Planning <br />Commission to recommend adoption of Resolution #20-085 approving the revocation of the <br />Conditional Use Permit (CUP) previously issued to Truck Garant for the property located at 6021 <br />Highway 10 NW. <br />Chairperson Bauer stated that he drove through the property and it has a junkyard look, noting that <br />the pictures in the staff report do not do the issue justice. <br />Citizen Innut <br />Roman Gadaskin, property owner, agreed that the site is a junkyard. He noted that he spoke with <br />the tenant multiple times and unfortunately the tenant refuses to comply. He stated that the tenant <br />is aware he continues to violate City Code. He stated that he took the tenant to court for eviction <br />but lost the case. He stated that he would like to complete the redevelopment of the property, but <br />the tenant is stopping the ability to do that. <br />Planning Consultant Maass stated that he has sent the operator updates throughout the meeting to <br />ensure that he could participate if desired, but the operator has not chosen to attend. <br />Motion by Commissioner VanScoy, seconded by Commissioner Johnson, to close the public <br />hearing. <br />A roll call vote was performed by the Deputy City Administrator: <br />Commissioner Johnson aye <br />Commissioner Anderson aye <br />Commissioner Gengler aye <br />Commissioner Woestehoff aye <br />Commissioner Peters aye <br />Commissioner VanScoy aye <br />Chairperson Bauer aye <br />Planning Commission/ May 7, 2020 <br />Page 27 of 29 <br />
