Co uncihnember introduced the following resolution and moved for its adoption: RESOLUTION # 05-05- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO JAMES AND CHERI WALLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE ALLOWED FOR ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF SAME: WHEREAS, James and Cheri Waller (Permittees) have properly applied for a conditional usc permit to exceed the maximuTM square' footage allowed for accessory buildings for properties betwee~.a 14,880 and 43,559 square feet as established in section 9.11.02 "Accessory Uses" of City C,~)de on thc property generally known as 17937 Fluorine St NW and legally'described as follows: Lot 5, Block 7, Ford Brook Estates, Anoka County, Minnesota (Subject Property) WItEREAS, the Planning Commission met on May 5, 2005, conducted the public hearing and recommended City Council approval of the request; NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as folloWs: Based on Findings of Fact # ., a conditional use permit (Permit) to exceed the maximum allowable square footage for accessory building space on properties between 14,880 and 43,559 square feet in size, is hereby granted to James and Cheri Waller, hereinafter referred to as the "l~erm ittees". That the overall square footage for accessory buildings may exceed the 1,488 square foot accessory building size restriction for properties between the size of 14,880 and 43,559 square feet by a total of 160 feet in order to accommodate the inside storage of private-use equipment That the maximum allowable height of the sidewalls is restricted to ten (10) feet. 4. That the construction of the detached accessory building on the SUbject Property shall require issuance ora building permit from the City of Ramsey. That thc accessory building shall be properly constructed and maintained in accordance with all applicable MN State Building Codes. 6. Tloc I'crmi. ttecs herein agree that no business use will be operated in the detached accessory building unless such use is permitted in accordance with the City Code. 7. That this Permit shall be perpetual in duration as long as the terms are herein complied with. :~.
