Co uncihnember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 05-05- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />JAMES AND CHERI WALLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE <br />ALLOWED FOR ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT # <br />AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, James and Cheri Waller (Permittees) have properly applied for a conditional <br />usc permit to exceed the maximuTM square' footage allowed for accessory buildings for properties <br />betwee~.a 14,880 and 43,559 square feet as established in section 9.11.02 "Accessory Uses" of City <br />C,~)de on thc property generally known as 17937 Fluorine St NW and legally'described as follows: <br /> <br />Lot 5, Block 7, Ford Brook Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WItEREAS, the Planning Commission met on May 5, 2005, conducted the public <br />hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as folloWs: <br /> <br />Based on Findings of Fact # ., a conditional use permit (Permit) to exceed the maximum <br />allowable square footage for accessory building space on properties between 14,880 and 43,559 <br />square feet in size, is hereby granted to James and Cheri Waller, hereinafter referred to as the <br />"l~erm ittees". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,488 square foot <br />accessory building size restriction for properties between the size of 14,880 and 43,559 square <br />feet by a total of 160 feet in order to accommodate the inside storage of private-use equipment <br /> <br />That the maximum allowable height of the sidewalls is restricted to ten (10) feet. <br /> <br />4. That the construction of the detached accessory building on the SUbject Property shall require <br /> issuance ora building permit from the City of Ramsey. <br /> <br />That thc accessory building shall be properly constructed and maintained in accordance with all <br />applicable MN State Building Codes. <br /> <br />6. Tloc I'crmi. ttecs herein agree that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br />7. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />:~.
