CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO MAINTAIN HORSES ON LESS THAN THREE ACRESi <br />CASE OF THERESA DAHLHEIMER <br /> By: Mcgan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />On February 28, 2000 the City received a telephone complaint that the property owners <br />of 8820 181st Avenue are exceeding the permitted number of horses on their property. <br />The City conducted an inspection of the property on March 16, 2000 and saw two horses <br />on the subject property. Staff verified the parcel to be 2.5 acres in size. City Code states <br />that parcels between 1.5 and less than 3 three acres in size are permitted to maintain two <br />horses with a conditional use permit issued by the City. The property file did not reflect <br />an issuance of a conditional use permit. Therefore the City sent notification on April 11, <br />2000 to the property owners stating that there was a violation of Ramsey City Code and <br />gave solutions to remedy the violation. <br /> <br />Theresa Dahlheimer contacted the City and stated that she does own 2.5-acres and is also <br />renting approximately 4 + acres from a neighbor. Ms. Dahlheimer is requesting a <br />conditional use permit to maintain a total of four horses on less than 3 acres based on the <br />fact that she rents approximately 4 acres from a neighbor, for a total of 6.5 acres. The <br />subject property is located at 8820 181st Avenue and the applicant is renting property <br />located at 8840 181st Ave. <br /> <br />The following information is enclosed for your review: <br /> <br />a) Site Location Map <br />b) Site Plan <br />c) Letter of Application <br />d) Letter to the Applicant dated April 11, 2000 <br />e) Statement from Theresa Dahlheimer regarding leased property <br />f) Letter to Theresa Dahlheimer explaining complaint dated October 24, 2000 <br />g) Letter from Greg Matuseski dated January 15, 2001 <br />h) Horse Board meeting minutes dated January 17, 2001 <br />i) Proposed Findings of Fact <br />j) Proposed Conditional Use Permit <br /> <br />Notification: <br /> <br />State law requires that properties within 350 feet of the subject property be notified of the <br />public hearing. Due to the large lot development Staff attempted to notify property <br />owners within 500 feet of the subject property. <br /> <br /> <br />
