CASE # <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT TO <br />EXCEED ACCESSORY STRUCTURE SPACE RESTRICTIONS; <br />CASE OF CHARLES DAVIS <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />The City received an application from Mr.- Davis for a conditional use permit to exceed the total <br />amount of garage and accessory building space allowed on his property at 14490 Bowers Drive <br />N.W. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Construction Plan <br />d) Site pictures <br />e) Proposed findings of fact <br />f) Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State statute, City Staff attempted to notify owners of property within 350 <br />feet of the Subject Property of the request and the public hearing date. <br /> <br />Observations: <br /> <br />The subject property is approximately .7 acres in size and is zoned R-1 Rural Residential. On a <br />.7 acre parcel, City Code allows a maximum-of 1,488 square feet of accessory structure space. <br />Accessory structures include all attached and detached garages and outbuildings in excess of 120 <br />square feet in size. (Structures 120 square feet and less in size do not require a building permit <br />and therefore are not considered permanent structures and do not count against the total amount <br />of accessory structure space allowed on a property.) <br /> <br />The Davis' have a 576 square foot attached garage and a 120 square foot garden shed. Reducing <br />the 1,488 restriction by 576 square feet £esults in a accessory structure allowance of 912 square <br />feet remaining on the property. Mr. Davis is proposing to build a 960 square foot (24'x40') <br />detached garage for the storage of personal property. This proposal results in a 48 square foot <br />overage in the amount of accessory structure space allowed on the property. Similar permits <br />have been granted in the past. <br /> <br />Recommendation: <br /> <br />The request is minimal and the City is interested in reducing outside storage in residential <br />neighborhoods. City Staff is recommending approval of the 48 square foot overage. <br /> <br /> <br />
