CASE REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED ACCESSORY STRUCTURE SPACE RESTRICTIONS; CASE OF ROGER AND SUE BUTLER By: Sylvia Frolik, Community Development Director Background: The City received an application from Roger Butler for a conditional use permit to exceed the total amount of garage and accessory building space allowed on his property at 16351 Azurite St. N.W. The following items are enclosed for your information: a) Site location map b) Site plan c) Front elevation of proposed building d) Site pictures e) Proposed findings of fact f) Proposed conditional use permit Notification: In accordance with State statute, City Staff attempted to notify owners of property within 350 feet of the Subject Property of the request and the public hearing date. Observations: The subject property is approximately .86 acres in size and is zoned R-1 Rural Residential. On a .86 acre parcel, City Code allows a maximum of 1,488 square feet of accessory structure space. The Butler's have a 528 square foot attached garage and a 624 square foot detached garage, for a total of 1,152 square feet. They are proposing to add another detached garage to the property at a size of 960 square feet, which would bring the total amount of garage space to 2,112 square feet. This is a 624 square foot overage in allowable accessory structure space. The Butler's are proposing to store their recreational vehicle and other personal vehicles and equipment in the building. The exterior construction materials would match the home; vinyl siding and asphalt shingles. The building will not exceed 'the 22 foot height limit. Similar permits have been granted in the past. Recommendation: The request is minimal and the City is interested in reducing outside storage in residential neighborhoods. City Staff is recommending approval of the request.
