Case

REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE
STEEL WAREHOUSE BUSINESS IN A RESIDENTIAL DISTRICT
CASE OF SCOTT AND PATTI JAR_MOL~
By: Megan Wald, Community Development Assistant

Background:

Lonny Menard resides at 8940 181st Ave and currently owns the parcel to the west (8900
181st Avenue). In 1985 Lonny constructed a 5,000 (50' x 100') square foot pole budlding
on the parcel to the west without also constructing a principal dwelling. City Code states
that no accessory structure shall be built w4thout the presence of a principal structure
(dwelling) on the property. This would resuk in ttxe existing accessory structure being
considered illegal non-conforming.

Mr. Menard has been operating his structural steel and commercial fencing business for
the past fifteen (15) years in the non-conforming accessory building. Mr. Ivlenard is in the
process of selling the subject property and moving his business to his homestead.

As you may recall, in May of 2000 Mr. Barrett applied for a conditional use permit to
operate a woodworking business on the property in the non-conforming accessory
structure. Mr. Barrett was proposing a 6,000 square foot expansion, employee and
customer parking, daily deliveries, and future plans for self-storage units. The City
Council denied the conditional, use permit on May 23, 2000 due in large part to the
Applicants desire for a large expansion.

Subsequent to that time the City. has received a conditional use permit from Scott and
Patti Jarmoluk of North Suburban Steel Supply, Inc. to operate a steel warehouse
business in the accessou structure on the prope~wy located at 8900 18 lSt AvenUe.

The following items are enclosed for your information:

a) Site Location Map
b) Site Sketch
c) Site Picture
d) Application information dated July 2, 2001
e) Letter from Applicant dated July 30, 2001
f) Planning Commission meeting.minutes dated lvl. ay 2, 2000
g) City Council meeting minutes dated May ..>, 2000
h) Proposed Findings of Fact
i) Proposed Conditional Use Permit '~

-103-
