Case # <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO DISPLAY AN ADVERTISING SIGN IN A RESIDENTIAL DISTRICT; <br />CASE OF TIMOTHY BERGERSEN <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Timothy Bergersen has applied for a conditional use permit to display an advertising sign in a <br />residential district on the property located at 6211 167th Avenue. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site Location Map <br />Sign Plan <br />Sire Pictures <br />Proposed Findings of Fact <br />Proposed Conditional Use Perm/t <br /> <br />Notification: <br /> <br />In accordance with State law, City Staff attempted to notify all owners of property within 350 <br />feet of the boundaries of Mr. Ber,ersen s property., of the request for a conditional use permit <br />and the public hearing date. <br /> <br />Observations: <br /> <br />Mr. Bergersen is self-employed and has a landscaping business. He parks h/s commercial <br />vehicles and equipment at his residence (6211 167m Avenue N.W.). He does comply with the <br />requirement to have his commercial vehicles and equipment stored indoors or in an area that <br />screens the equipment to a degree of 75% f. rom the public road and adjacent properties. <br /> <br />However, Mr. Bergersen also desires to advertise his business and erected 32 square foot sigT~ at <br />the entrance to his property. Mr. Bergersen's property is zoned R-1 Rural Residential and City <br />Code does not make provisions for advertising signs in residential districts. The sig-n was brought <br />to the attention of City Staff and Mr. Bergersen was advised to remove the sign or attempt to <br />obtain a conditional use permit for the continued use of the sign. <br /> <br />Mr. Ber~ersen s property is located on a Murficipal State Aid road. There is a church west of his <br />property and there is a commercial district a short distance to the east. The sign is professionally <br />done with substantial landscaping improvements around it. <br /> <br />In the recent past, the Council approved a conditional use perm_it for a home business On Hr,7. <br /># 10 that included a business sign, given the fact that the use was on a State Highway, across the <br />street from commercial uses. (The Home OccupatiOr~;~sec):.ion of City Code does not permit <br />sig'nage of home businesses.) Some years ago, the Council also granted a permit for a siffn on <br />T.H. #47 for an agr/culture business in a Residential district. <br /> <br />-51- <br /> <br /> <br />
