CASE <br /> <br /> REQUEST TO REZONE CERTAIN PROPERTY <br /> FROM R-1 RURAL RESIDENTIAL TO R-1 URBAN RESIDENTIAL; <br />CASE OF JACOB BARTHOLD AND OAKWOOD LAND DEVELOPMENT, INC. <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Jacob and Therese Barthold and Oakwood Land Development are requesting a rezoning of <br />property in Section 14 from R-1 Rural Residential to R-1 Urban Residential to permit <br />development of the subject property with single family residential lots served by sanitary sewer <br />and municipal water. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) General development plan <br />c) Proposed Findings of Fact <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 feet of <br />the subject property. Staff attempted to notify property owners within 700 feet of the subject <br />property of the request for rezoning. <br /> <br />Observations: <br /> <br />The property is approximately 9.7 acres in size. <br /> <br />At Mr. Barthold's request, the subject property was part of a Comprehensive Plan amendment <br />initated in 1993 by the City of Ramsey for a MUSA boundary expansion. By the time the <br />amendment was approved by Metro Council in 1995, a portion of Mr. Barthold's property, which <br />is the subject.of today's request, was not included in the MUSA boundary expansion exhibit. The <br />fact that this portion of Mr. Barthold's property is not in the MUSA came to light during the <br />preliminary plat review of Apple Ridge (ensuing phases named River Pines) in 1997. The <br />preliminary plat was modified to eliminate this portion of Mr. Barthold's property. Therefore, the <br />current Comprehensive Plan retains this property for single family residential uses at rural <br />standards. <br /> <br />The March 2001 Draft Comprehensive Plan proposes to include the subject property in the <br />MUSA expansion area in order to complete the River Pines subdivisions. The fact that 158t~ Lane <br />in River Pines 2na Addition dead ends on the west boundary of the subject property is problematic <br />and presents a public safety concern since the length of this dead end is greater than 600 feet. A <br />66 foot wide dead end does not provide a sufficient amount of area for the safe and efficient <br />operation of municipal maintenance equipment, particularly snow plows. Development of River <br />Pines 5th Addition will extend 158~ Lane to the east and then turn south to connect with Lithium <br />Street in Apple Pddge. This through street alleviates a major issue for the Public Works <br />Department. <br /> <br /> <br />
