CASE #: <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO GRADE AND EXPORT SOILS; CASE OF JOHN ENSTROM <br />By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />On September 23, 1997, the City issued a-conditional use permit over a 12-acre area to Mr. John <br />Enstrom to grade and export approximately 114,000 yards of soils from his property at 8701 <br />181st Avenue N.W. The purpose of the permit was to create a pond on the property, dry the <br />excavated materials and export them off the site as topsoil. That permit expired October 31, <br />2001 and Mr. Enstrom has applied for another conditional use permit to complete the grading <br />and excavation project. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />d) <br />e) <br /> <br />Site Location Map of all property owned by Mr. Enstrom <br />Exhibit of Enstrom Property and Project Site Area dated November 3, 2001, <br />prepared by City Staff <br />Applicant submittals consisting of letter of request and a one sheet sketch <br />showing the extent of soil removals in the area originally approved for the 1997 <br />Mining and Grading Permit and extent of area to be completed <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify all owners of property within 350 <br />feet of Mr. Enstrom's property of the request for conditional use permit and related public <br />hearing. <br /> <br />Observations: <br /> <br />An exhibit has been prepared by the applicant which' illustrates the extent of the excavation <br />completed to date under the mining and grading conditional use permit issued in September <br />1997. A site visit conducted by Staff on October 27, 2001 corroborated the relative accuracy of <br />this sketch. The original excavation proposed is approximately 60% complete at this time. <br /> <br />County ditch 51, which is located along the southern boundary of the excavation has been left <br />undisturbed by the excavation by a 20 to 30 foot buffer strip. A hydraulic connection to the <br />County ditch from the excavated lake is located on the southeast corner of the excavated lake. <br /> <br /> <br />
