CASE #: REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT SOILS; CASE OF JOHN ENSTROM By: City Engineer Steve Jankowski Background: On September 23, 1997, the City issued a-conditional use permit over a 12-acre area to Mr. John Enstrom to grade and export approximately 114,000 yards of soils from his property at 8701 181st Avenue N.W. The purpose of the permit was to create a pond on the property, dry the excavated materials and export them off the site as topsoil. That permit expired October 31, 2001 and Mr. Enstrom has applied for another conditional use permit to complete the grading and excavation project. The following items are enclosed: a) b) c) d) e) Site Location Map of all property owned by Mr. Enstrom Exhibit of Enstrom Property and Project Site Area dated November 3, 2001, prepared by City Staff Applicant submittals consisting of letter of request and a one sheet sketch showing the extent of soil removals in the area originally approved for the 1997 Mining and Grading Permit and extent of area to be completed Proposed findings of fact Proposed conditional use permit Notification: In accordance with State Statute, City Staff attempted to notify all owners of property within 350 feet of Mr. Enstrom's property of the request for conditional use permit and related public hearing. Observations: An exhibit has been prepared by the applicant which' illustrates the extent of the excavation completed to date under the mining and grading conditional use permit issued in September 1997. A site visit conducted by Staff on October 27, 2001 corroborated the relative accuracy of this sketch. The original excavation proposed is approximately 60% complete at this time. County ditch 51, which is located along the southern boundary of the excavation has been left undisturbed by the excavation by a 20 to 30 foot buffer strip. A hydraulic connection to the County ditch from the excavated lake is located on the southeast corner of the excavated lake.
