The Commission was comfortable with Mr. Martinson's explanation. <br /> <br />Mr. Martinson requested that # 19 of the conditional use permit be amended to read "Operations <br />at the facility shall be maintained," deleting the reference to 'equipment'. <br /> <br />Consensus of the Commission was to make that change. <br /> <br />Chairperson Nixt noted that #38 should incorporate the reference to the May 25, 2001 letter and <br />requested that staff verify that the insurance limits are acceptable. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson, to recommend that City <br />Council adopt Findings of Fact relating to St. Paul Terminals' request for a conditional use <br />permit for a recycling and aluminum processing facility and to recommend that City Council <br />approve St. Paul Terminals request for a conditional use permit based on the findings of fact, and <br />adopt the permit as proposed and revised. <br /> <br />Motion Carried. Voting No: None. <br /> <br />Case #12: <br /> <br />Review Proposed Ordinance to Amend Regulations Relating to the Keeping <br />of Animals <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 10:58 p.m. <br />in order to call the public hearing to order. . <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 10:58 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that City staff has been working with the Horse <br />Care Board for several months to review and update the City's regulations for keeping farm <br />animals and horses. The current farm animal ordinance states that a property owner may have <br />two goats, pigs, or cows in any combination, as long as they have 3-20 acres of land and a <br />conditional use permit from the City. Beyond 20 acres, there are no limits on the kinds and <br />numbers of animals they may have. Currently, there are no regulations regarding the keeping of <br />exotic animals such as ostriches. The result of this effort is threefold. First of all, it .was <br />recommended that the farm animal ordinance redefine the list of farm animals to include cows, <br />llamas, mules, donkeys, burros, ponies, goats, pigs, sheep, lamb, turkey, geese, chickens, and <br />ducks. Each type of animal is assigned a number of animal units based on production of waste. <br />Then an appropriate number of animal units is prescribed for various size parcels ranging from 3 <br />to 20+ acres.
