Community Development Intern Kielbloek explained that the Fire Department was concerned <br />about fire trucks gaining access to the site. <br /> <br />Mr. Ballard replied that the road is not owned by the landowner or himself, so he would have to <br />get permission from Adolfson Peterson before doing anything to the driveway. <br /> <br />Chairperson Nixt stated that the question becomes the area of operation and suggested that the <br />Commission could recommend approval conditioned upon suitable safety standards being met <br />which could be left up to City staff to work out. <br /> <br />Mr. Ballard stated that the property owner has made it very clear that he will have to use the <br />property at grade or he won't lease him the space. He will be dealing with concrete materials and <br />there will be nothing flammable on the site. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Reeve, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Reeve, Kociscak, <br />Sweet, Watson, and Wivoda. Voting No: None. <br /> <br />The public hearing closed at 7:26 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:26 <br />p.m. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to recommend that <br />City Council adopt Findings of Fact relating to David Ballard's request for an interim use permit <br />for a temporary concrete batch plant. <br /> <br />Further discussion: Chairperson Nixt inquired if the 36 foot height for the silo would need a <br />variance. Community Development Director Frolik replied that City Code exempts silos from <br />the height restriction requirement. <br /> <br />Motion CmTied. Voting Yes: Chairperson Nixt, Commissioners Johnson, Kociscak, Reeves <br />Sweet, and Watson. Voting No: None. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to recommend that <br />City Council approve the issuance of an interim use permit to David Ballard for a temporary <br />concrete batch plant, based on the findings of fact, and adopt the resolution declaring the terms as <br />proposed with the second portion of #7 being deleted, #8 being deleted, and #4 include a drawing <br />of the proposed class-five area, and determining whether a separate surety would be required <br />from Mr. Ballard. <br /> <br />Planning Commission/July 12, 2001 <br /> Page 4 of 23 <br /> <br /> <br />
