Record ID 1515083 1972259.006 Councihncmber Cook introduced the following resolution and moved for its adoption: RESOLUTION # 04-09-271 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO MICtIAEL METTLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE ALLOWED FOIl ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT #0697 AND DECLARING TERMS OF SAME: WtlEREAS, Michael Mettler (Permittee) has properly applied for a Conditional Use Permit to exceed the maximum square footage allowed for accessory buildings for properties between 1 and 1.99 acres as established in section 9.11,02 (Accessory Uses) of City Code on the property generally known as 15315 Sunfish Lake Blvd NW and legally described as follows: Thc south 194.5 feet of that part of the Southwest Quarter of the Northwest Quarter of Section 23, Township 32, Range 25, Anoka County, Minnesota lying easterly of the centcrline of County State Aid Highway Number 57. Excluding road and subject to casements ol~ record. (Subject Property) WItEREAS, the Planning Commission met on September 2, 2004, conducted the public hearing and recommended City Council approval of the request; NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: J3ascd on Findings of Fact #0697, a Conditional Use Permit (Permit) to exceed the maximum allowable square footage for accessory building space on properties between 1 and 1.99 acres in si zc is hereby granted to Michael Mettler, hereinafter referred to as the "Permittee". That the overall square footage for accessory buildings may exceed the 1,664 square foot accessory building size restriction for properties between 1 and 1.99 acres by a total of 264 square Feet in order to accommodate the inside storage of private-use equipment and vehicles. Thai the construction of the addition on the detached accessory building on the Subject Property shall require issuance of a building permit from the City of Ramsey. 4. ~l'hat thc accessory building shall be properly constructed and maintained in accordance with all applicable International Building Codes. 5. The Pcrmittee herein agrees that no business use will be operated in the detached accessory building unless such use is permitted in accordance with the City Code.
