CASE # <br /> <br />REQUEST FOR A VARIANCE TO THE REAR YARD SETBACK; <br />CASE OF KARL AND BETH VIRKUS <br /> By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />Mr. Virkus has applied for a variance to encroach into the rear yard setback in order to construct <br />an addition onto the principal structure on the property located at 16940 Azurite Street NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Observations: <br /> <br />Mr. Virkus would like to construct an addition onto his home in order to expand his garage and <br />entryway space. The addition is proposing to encroach five feet into the 35-foot rear yard <br />setback established in the R-IR Rural district. The Applicant has stated that the additional five <br />feet of space is needed in order to house all of his vehicles and private use equipment. <br /> <br />Mr. Virkus's house was built in the 1970's when the policy was to construct houses to one side <br />of the lot so as not to obstruct any future resubdivision. The Virkus's home is located along the <br />very northern edge of the subject property. The addition cannot extend any further to the north <br />without encroaching into the side yard setback. The property also contains heavy vegetation and <br />low areas along the southern portion of the property and therefore prohibits the construction of a <br />detached accessory building. The proposed addition also cannot extend any more to the south <br />due to the location of the well (see site plan). <br /> <br />The proposed addition will not exceed the accessory building square footage restrictions <br />established in City Code. The subject property is 1.3-acres in size and city code allows 1,664 <br />square feet of accessory building space. The proposed entry and garage addition will consist of <br />1,600 square feet and the property does not contain any other accessory buildings that count <br />against the total allotment of accessory building space. <br /> <br />Recommendation: <br /> <br />Due to the location of the house, the well, and the property containing heavy vegetation and low <br />areas in the southern portion of the subject property, Staff recommends approval of the variance. <br /> <br /> <br />
