CASE # <br /> <br />REQUEST FOR A VARIANCE TO THE SIDE YARD AND SEPTIC SYSTEM <br />SETBACK REQUIREMENTS; <br /> CASE OF JOHN AND JULIE DEHEN <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />John and Julie Dehen have applied for a variance to encroach the side yard setback in order to <br />construct a. new attached garage and a variance to the minimum separation between a septic tank <br />and building in order to replace their non-conforming system on the property located at 14806 <br />Bowers Drive N.W. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Letter from Applicant dated May 18, 2001 <br />c) Site plan <br />d) Site photographs <br />e) Proposed Findings of Fact <br />f) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify all owners of property within 350 feet <br />of the subject property of the request for variance and public hearing date. <br /> <br />Observations: <br /> <br />The Dehen's would like to remodel their home to convert their existing attached garage into a <br />family room, expand their front foyer, raze the detached, single car garage and add a new <br />attached garage. They have a very narrow lot on Bowers Drive with a sharp increase in <br />topography on the north and sharp decline in topography on the south. The new attached garage <br />would encroach on the adjacent parcel to the north, 4 feet at the most intense point of <br />encroachment. The neighbors (Millers) are willing to sell the Dehens, through an administrative <br />subdivision approved at the City Staff level, the portion of property necessary to facilitate the <br />encroachment. However, the Millers only want to sell the Dehens the minimum amount of <br />property necessary to facilitate the footprint of the garage; they are not willing to sell the Dehens <br />additional property to provide for the 10 foot side yard setback. They plan to grant an easement <br />to the Dehens to trespass onto their property when it is necessary to do so in order to conduct <br />maintenance activities on the north wall or roof of the garage. Therefore, the Dehens need a <br />variance for a zero setback on the north side yard. The nearest structure on the Miller property is <br />a detached garage that is approximately 23 feet away from the Dehens proposed new garage. <br /> <br /> <br />
