CASE # <br /> <br />REQUEST FOR A VARIANCE TO THE SIDE YARD SETBACK; <br />CASE OF THOMAS AND CAROLE RACHEL <br /> By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />Mr. Rachel came to the City and applied for a building permit to construct a detached accessory <br />structure at on his property located at 6350 163rd Lane NW. During the inspection of the <br />footings it became apparent to the Building Inspector that the detached accessory structure was <br />being constructed too close to the side yard lot line. The Building Inspector and Mr. Rachel <br />contacted Staff in the Community Development Department, who in mm verified that the <br />detached accessory structure would be encroaching upon the side yard setback. <br /> <br />Per Staff's recommendation, Mr. Rachel has since then applied for a variance to the side yard <br />setback in order to construct a detached accessory structure on the property. <br /> <br />Observations: <br /> <br />City Code requires a 35-foot side yard setback on comer lots for both principal and accessory <br />structures. Mr. Rachel's building is proposing to be 15 feet from the side property., line. The <br />subject property is bounded by 167 Lane to the north and Wolf:ram Street to the west. If the <br />Applicant were to construct the 24'x 28'(672 square feet) detached accessory structure in <br />compliance with City Code, the structure would be encroaching upon the existing drain field and <br />both of the alternate drain fields. The Applicant would also have to remove existing vegetation, <br />which primarily includes mature trees. <br /> <br />The proposed detached accessory structure will not exceed the accessory building square footage <br />restrictions established in City Code. The subject property is .7-acres in size (31,229 square feet) <br />and City Code allows 1,488 square feet of accessory building space. The Applicant is proposing <br />to have a total of 1,332 square feet of attached and detached accessory building space on the <br />subject property. <br /> <br />Recommendation: <br /> <br />Due to the location of the existing drain field, alternate drain fields, and existing mature trees, <br />Staff recommends approval of the variance. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Site Pictures <br />d) Proposed Findings of Fact <br />e) Proposed Variance <br /> <br />-1- <br /> <br /> <br />
