<br /> <br />Councilmember Kuzma introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #20-137 <br /> <br />RESOLUTION APPROVING AN EASEMENT ENCROACHMENT AGREEMENT FOR <br />A MONUMENT SIGN TO BE INSTALLED IN A DRAINAGE AND UTILITY <br />TH <br />EASEMENT AT 8019 146 AVE NW AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, PSD, LLC doing business as Armstrong West Retail Mall, LLC hereinafter <br />referred to as the “Applicant”, has requested an Encroachment Agreement to facilitate the <br />installation of a monument sign (the “Sign”) within a drainage and utility easement (the <br />th <br />“Easement”) on the property generally known as 8019 146 Ave NW and legally described as <br />follows: <br /> <br />Lot 2, Block 1 West Armstrong Addition, Anoka County, Minnesota <br /> <br /> (“Subject Property”) <br /> <br /> WHEREAS, the Applicant received a Permanent Sign Permit to install the Sign on the <br />Subject Property; and <br /> <br /> WHEREAS, the Applicant received a Conditional Use Permit (CUP) for the size of the <br />sign on the Subject Property; and <br /> <br /> WHEREAS, the Engineering Department has reviewed the sign base and determined that <br />the Sign was placed in the Easement and has determined the Easement can still function as <br />designed with the encroachment of the Sign; and <br /> <br /> WHEREAS, the City Council reviewed the request on June 23, 2020. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That, contingent upon the Applicant entering into an Easement Encroachment Agreement <br />with the City and recording said agreement against the Subject Property, the Applicant <br />may install and maintain the Sign in accordance with the terms and conditions contained <br />within the Easement Encroachment Agreement. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Riley, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor LeTourneau <br /> Councilmember Kuzma <br /> Councilmember Riley <br /> Councilmember Heinrich <br /> Councilmember Menth <br /> <br /> <br />
